TITLE II – PREAMBLE

CLAUSE A – PURPOSE OF THIS NOTICE  

This document refers exclusively to the Site https://ombf.it/it/ (hereinafter referred to exclusively with the word “Site)

It is specified that all information contained in our Site refers to the latter and are valid for it and not for other web sites, the User might consult through links on the platform. The Owner has no control on these sites and neither on the procedures applied by them for the protection of personal data, therefore we recommend consulting the norms about the privacy of data protection of all subjects with whom you may get in contact before providing personal information.

This document is aimed at informing the User on the retention of the so-called cookies on its terminal by this Internet Site.

CLAUSE B – TO WHOM THIS NOTICE IS DIRECTED  

To the to the User, i.e. You, also called the PERSON CONCERNED, the subject consulting the web site, be it a physical person or a subject operating in name and behalf of legal persons providing personal data.

TITLE III - DEFINITIONS

CLAUSE A - WHAT ARE COOKIES AND OTHER TRACKING TOOLS?

1. The cookies.

They can be defined as “text strings the websites (the so called Publisher, or “first parties”) visited by the User or different sites or web servers (the so called “third parties”) position and file – directly in the case of the publishers and indirectly, i.e. through the latter ones in case of ”third parties” – in a terminal device (i.e. a computer, a tablet, a smartphone, or any other device able to store information) in the User’s availability ”.

The information codified in the cookies can collect personal data, such as an IP address, a User name, a unique identifier or an email address, but they may also contain non-personal data, such as the language settings and the information on the type of device a person is using to browse the site. So through cookies it is possible: 1) to allow, among other things, web pages to load faster, to route information on a network - therefore, in line with obligations strictly related to the operation of the websites themselves, 2) to convey behavioural advertising (so-called "behavioural advertising") and then measure the effectiveness of the ads, i.e. form, type and methods of the services provided to the behaviours of the User object of the observation.      

2. Other tracking tools.

They can be defined as passive identifier that enable performing analogous processing similar to the above-mentioned ones. They include the fingerprinting, “i.e. the technique that allows identifying the device used by the User by collecting all or some information relating to the specific setting of the device itself adopted by the data subject. Such technique can be used for the same profiling purpose also aimed at visualizing customized behavioural advertising, analysing and monitoring the behaviours of the visitors of websites or conforming the type and methods of the services provided to the behaviours of the User object of a preceding observation. ”.

CLAUSE B – CLASSIFICATION OF THE COOKIES

- From a temporal point of view, considered according to their duration, they are divided into Session Cookies (they last until your internet browser is closed) or Permanent Cookies (they are constant and continue to operate after the User's browser is closed, e.g. the cookie for the choice of language, which allows, in future accesses by the User, to be automatically directed to the site with the language chosen).

- From the point of view of origin, from a subjective point of view, they are subdivided into First Party cookies (sent to the User's browser directly from the site he/she is visiting, and belong to this) or Third Party cookies (i.e. those that belong to domains other than the one shown in the address bar, that is, different from the Site he/she is visiting). 

- in terms of the purpose (i.e. based on the use) of the processing of personal data, they are divided into Technical Cookies (used for browsing on the internet page, not requiring the consent of users), Statistical Cookies (used for the purpose of optimizing the site, directly by the Controller of the site itself, which may collect information in aggregate form on the number of users and how they visit its site), marketing and profiling cookies (advertising cookies aimed at providing advertising spaces. The Controller of the site or third parties may install them only after obtaining the consent of the User; third companies may send them to the browser of the User, directly from their sites, for their purposes, possibly including profiling).

TITLE IV – THE PRINCIPAL COOKIES USED BY OUR SITE

By virtue of the GDPR and the Guidelines of GPDP, the classification, which responds to the rationale of the law, and therefore also to the needs for the protection of the person, is connected to the purpose of the processing (see art 5 paragraph 1 b) of GPRDP). Therefore, this paragraph will indicate the criteria of notification implemented by the site depending on the purposes of the processing.

CLAUSE A – TECHNICAL AND FUNCTIONAL COOKIES

Used with the only aim of “performing the transmission of a communication over an electronic communication network or, to the extent strictly necessary, to the provider of an information service company explicitly requested, to provide that service by the contractor or the user” (see art. 122, paragraph 1 of the Privacy Code). These provide for making the web site usable, habilitating its basic functions and do not require the consent of the Users because the web site cannot work correctly without these cookies. 

The functional and technical cookies used by the Site are:

• Purpose: session or browsing Cookies: they grant the normal browsing and use of the web site (for ex. allowing browsing the pages, accede to the protected areas of the site, payment of credit card or other systems, etc.)    

Functional Cookies used to facilitate the personal customized experience of browsing by the User (e.g. keep memory of the language chosen.

LEGAL BASIS: Execution of a service, a contract or measures pre-contractual measures pursuant to art. 6, par. 1, letter b)

2. Functional Cookies

Google reCAPTCHA (Google Inc.)

Used only to analyse the traffic of the Site of O.M.B.F. IN ORDER TO FILTER the array of data to eliminate parts of traffic, messages and contents recognised as SPAM

• Purpose: Functional cookies used to guarantee the maximum level of security and protection of the site in favour of the User and our organization.

LEGAL BASIS: legitimate interest of the Owner, pursuant to art. 6, par. 1, letter f) of GDPR.

NATURE OF THE DATA TRANSFER: necessary for the connection to the site and for it to supply the service requested.  

PERIOD OF RETENTION: for the duration of the session.

CLAUSE B - STATISTICAL COOKIES 

For the statistical surveys of our site uses Google Analytics 4 that allows for greater privacy adjustments, these tools do not record or file the single IP addresses, Analytics supplies data on the approximate geographical position by obtaining the following metadata from the IP addresses: city (plus the derived latitude and longitude of the city), continent, Country, geographical area, subcontinent (and equivalent data based on ID). The data of the Users located in the SEE, and Google Analytics 4 collect all these data (depending on the geographical research of the IP) through domains and servers located in the EU before forwarding the traffic to the servers of Analytics for the collaboration.

• Purpose: they are used to allow the Owner to optimize the Web site directly,
  for the design of the Site or to help measure its "traffic", i.e. the number of visitors, possibly broken down by geographical area, time of connection or other characteristics.

NATURE OF THE DATA TRANSFER: optional, consent is expressed by the User via the cookie information banner.

CLAUSE C – ADVERTISEMENT AND MARKETING COOKIES 

“used to trace back to specific, identified or identifiable subjects, specific actions or recurring behavioural patterns in the use of the features offered (patterns) in order to group the different profiles within homogeneous clusters of varying sizes, so that the data controller can, among other things, also modulate the provision of the service in an increasingly personalized manner beyond what is strictly necessary for the provision of the service, as well as send targeted advertising messages, i.e. in line with the preferences expressed by the user while browsing the internet” (see art. 4 of the GDPR Guidelines of 10.06.2021).

• Purpose. These cookies are intended to provide advertising space. They can be installed by the website Owner or by third parties only after obtaining the user's consent; they can be sent to the user's browser by third-party companies directly from their websites for their own purposes.

The Data Controller has no control over third-party cookies, either over the activity and purpose of the third party, or over the possibility that the third party may modify them over time. Our website uses Google Ads marketing features. These features allow us to display ads based on the user's personal interests, identified through an analysis of the user's web behaviour, whether on a mobile device or other devices. As required by current privacy legislation, prior consent is required for the installation of these cookies.

Purpose: These cookies are set by doubleclick.net when remarketing is enabled. The purpose of the cookie is to determine whether the user's browser supports cookies.

Name: NID – AID – _gat - _gcl - _gid

Purpose: Cookies set by Google Analytics in order to publish and display ads, customize the ads, restrict the number of visualizations of an announcement for a user, disable the ads that the user has decided to no longer receive and evaluate the effectiveness of the ads. They are used to show Google ads in the Google services to the users who exited after performing the access after logging in.       

Retention: 12 months

Nome: SID

Purpose: they concern the security and are installed when the remarketing is activated. The cookies used for the security allow to authenticate users, prevent fraudulent activity, and protect users when interacting with a service.

TITLE V TRANSPARENCY IN THE USE OF COOKIES

We want to make the use of cookies and other similar features as transparent as possible.

The User can decide whether to accept the cookies or not, by using the settings of his/her browser

at his/her first access, through the banner, the User can:

- continue browsing maintaining the default settings that provide for the use of only the technical cookies of the site by selecting the X at the top right and closing the banner; this way, you can reject non-technical cookies.

At every subsequent access after the first 

– through the cookie bot icon located in the footer of each page of the site, the User can access a dedicated area and modify the consents previously selected. TITLE VII – RIGHTS OF THE PERSON CONCERNED     

Pursuant to Regulation UE 2016/679 ("GDPR”), the data subjects are entitled to receive the confirmation of the existence or not of said data and to know their content and origin, to check their exactness and request their integration or updating, or their rectification at any moment. Moreover, the data subjects are entitled to request the cancellation the limitation of the processing, and the portability of the data as well as to lodge a complaint to the supervisory authority and, in any case, to object to their processing for legitimate reasons (art. 17 et seq. of GDPR).
